Why Sanjay Dutt and not Zaibunisa Kazi or why both should be pardoned in Mumbai Blasts case...

Sanjay Dutt at his film shooting venue

Manoeuvring of its own kind has hit the Indian Superclass who are
queuing up to support Mr. Sanjay Dutt whose conviction order has been
upheld by SC on March 21st under the Arms Act for possession and
destruction of an AK-56 before the blasts. In the undesirable que up,
people are forgetting almost everything; from the one's who lost their
lives to those who are surviving with blemished scars to even those
convicts whose cases looks like being suppressed just because they
fall under 'faceless' dogmas.

It's understanding when Dutt's family, colleagues and fans argue over
his pardon but when arch-political class whom people look to as
'saviours of law and order' behaves in irresponsible way by supporting
a convict whom highest court of law has found guilty of crime, it
seems a bit of bizzarre. Not just them alone but it in a way shows
nation's judiciary in bad light. From Mamata Banerjee, Digvijay Singh,
Raj Thackeray, Amar Singh, Jayaprada to scores of others have pulled
in the mikes to their voice-boxes to seek sympathy for Mr. Dutt. Miss.
Banerjee was yet again at her worst when she argued for Dutt's pardon
solely because his father was respected congress politician and
revered actor appeared 'good to her'. Logic? Well only West Bengal CM
could answer or link them both!

Justice Markenday Katju
The debate over mercy for Sanjay Dutt has widened (or took shape) only
after PCI Chairperson Markenday Katju who is known for speaking on
random things sparked eyeballs by saying, 'he would write to
Maharashtra governor for pardon to Dutt'. Then, has Justice Katju
forgot or was totally unaware of other faceless criminals of society
who too might have suffered same or more tragic phase as Dutt has ever
underwent. Justice Katju had said "Dutt had underwent 20 years of
trauma (well in open space!), his film career has took backseat...."
Okay Sir, but what about those hundreds or thousands who were
traumatized in 1993 Mumbai Blasts? What about their keens?

Sanjay Dutt was found possessing AK-56 and even have been said to
provide shelter for four absconding criminals in his home. It's when
he already had four licenced pistols.

Everybody agrees it isn't tit-for-tat but what about equal justice &
fair trial? Didn't our preamble promise of equality in justice? Or
have we all forgotten the same?

There is this 75 year old muslim lady in her evenings who though has
been found guilty of same crime (possessing arms without licence) but
have been tried under TADA Act while Dutt have been tried under Arms
Act. No doubt, law in every aspect looks lenient here. Dutt on one
hand is fit and fine (or at least he looks so) but Zaibunisa Kazi is
in her tender old age and have recently been operated for a tumor in
her kidney which had made her still more weak finding hard even to
walk few straight steps. It's not much surprising how her story had
remained under wraps till her daughter recorded her mother's emotional
message to governor and uploaded it on internet which a news channel
quickly picked up and her case saw day's light which it actually
deserved much more than any other celebrity.

There have been widespread debate all over the nation over pardon for
both. People across borders have been asking - why only Sanjay Dutt,
why not Zaibunisa Kazi?

Some powerful voices have also started openly opposing the idea of
pardon. Janata Party president Subramanium Swami has already locked
horns with Press Council of India Chairperson Justice Markenday Katju
over pardoning Dutt. Swamy had said that, while granting a pardon, the
SC has laid down that "public welfare must be enhanced", which he said
is hard to see in Dutt's case. "Court has been extraordinarily lenient
to (Dutt) so far", several times so that Dutt was a film star who had
associated with criminals who have been linked to the 1993 blasts."

Mahesh Bhatt and many were quoting humanitarian grounds for Pardon.
Whichever ground or thesis one might quote, it's high time not to
influence judiciary as some media houses are already doing it right
now after Sanjay Dutt broke out in his Press Conference holding his
sister Priya Dutt. Show those clips; we understand it's your duty and
right but not with scarry background music!

Sanjay Dutt or Zaibunisa Kazi or any other who is convicted under this
or any other case, first let us not influence proceedings of law,
second let us not forget, we all were born as humans; no big, no small
and law of land must and should hold same for anyone and everyone; be
it a celebrity like Dutt or ordinary citizen like Zaibunisa. Law can't
have cherries for some and dry cups for others. If you ask & shout for
pardon for Sanjay Dutt then why not for 75 year old Zaibunisa Kazi who
can't even walk properly or needs medication every now and then? Why
double-standards of law in a single nation!

Let law take its course and let guilty be convicted or pardoned solely
upon their works and not by our influence or pressure.
